Illinois cannabis delivery providers file complaint on unlicensed operators

Thirteen cannabis delivery service providers in Central Illinois complaint against government regulators, alleging that they allow unauthorized operators to move the product.

The suit, filed Tuesday in Sangamon County Court, alleges that the Illinois Department of Agriculture and its administrator, Jerry Costello, are not enforcing provisions in the Illinois Cannabis Regulatory and Tax Act, or CRTA, that paved the way for the state’s adult use sales program. Launched in January 2020.

Among the plaintiffs’ complaints:

The Department of Agriculture failed to “manage and enforce” provisions of the CRTA and Transportation Regulations relating to the “supervision and registration” of transportation organizations and agents. The Ministry of Agriculture has not taken disciplinary action against any party involved in the illegal transfers because it does not have sufficient staff. The Agricultural Division “knowingly and knowingly” allows operators to conduct illegal cannabis transportation
